Q&A › Divorce, ʿiddah & rujuk

🚪 Divorce, ʿiddah & rujuk · #87

I have made up my mind to divorce my wife. How do I do it in the most dignified way?

Choose a calm time, not when you are angry, and tell her face to face with words that protect her dignity. Allah says: “Divorce is twice. After that — either retain in a proper manner, or release with kindness (ihsan)” (Surah al-Baqarah 2:229). Ihsan means you do not shame her, do not mention her faults in front of the children, and do not pronounce talaq by text message. Avoid pronouncing talaq while she is menstruating, and never pronounce a triple talaq all at once. Before you speak, plan where she will live during her waiting period (iddah), her maintenance (nafkah) and the children, so she is not left floundering. In Malaysia, a divorce application should be filed at the Syariah Court; if a pronouncement has already happened outside court, report it promptly for confirmation. Read also talaq guide.
