📘 What you will learn

Key point: Many claims about polygyny — such as a 'golden umbrella', a fine of only RM1,000, or women far outnumbering men — rest on no text or data. Husbands and wives should judge each claim against sources that can be checked, and understand that justice, registration and the rights of wives and children cannot be ignored.

This week's practice
  1. Choose one myth you have heard and check the facts and sources in the table on this page
  2. When you hear a religious claim, ask for the verse or hadith number and check it on sunnah.com or in the mushaf
  3. Check whether your marriage is registered and its certificate kept safely

How to check claims about polygyny

  • Ask for the verse or hadith number — check on sunnah.com or the mushaf
  • Law: ask for the name of the act or enactment and the section number
  • Figures: ask who published them and in what year
  • Figures without a source are best ignored
  • Distinguish fiqh rulings (valid, sinful) from state law (registered, an offence)

9The Syariah Court approves every polygyny applicationMore than a third of applications were refused in 2019–2023 (JKSM data). Approval rates also differ by state — FT 73%, Kedah 42% (2019–2022).The Straits Times, 20 Apr 2024 (JKSM data); UUM 2024 (FT and Kedah figures only)

2Myths about the rulings

The most frequent misunderstandings, which concern the Shariah rulings themselves.

1. “Polygyny is a sunnah required of every man”Fact: The majority of scholars class polygyny as permissible, and its ruling changes with the individual's circumstances (JHEAINS). The authoritative Shafi'i text states that "it is recommended not to take more than one wife without an evident need" (ash-Shirbini). Some scholars, such as Ibn Baz, regard it as recommended for those able. No recognised scholar makes it obligatory.
2. “A wife who accepts a co-wife is guaranteed a "golden umbrella" in Paradise”Fact: The JHEAINS enforcement leaflet states that the "golden umbrella" is found in neither the Qur'an nor the hadith. It is an invention. Patience in trials is indeed rewarded, but this particular reward has no source.
3. “Surah an-Nisa' 4:129 proves polygyny is forbidden because justice is impossible”Fact: Muhammad Abduh read 4:3 together with 4:129 as a very strict restriction. But the majority of scholars hold that the impossible justice is justice of the heart. The continuation of the same verse forbids "inclining completely" so that another wife is left hanging, and this shows that polygyny is still permitted. Justice in maintenance and the rotation of nights remains obligatory (Sunan Abu Dawud 2133, sahih). See Contemporary scholars' views.
4. “The first wife can forbid her husband to practise polygyny”Fact: According to JHEAINS, the wife has the right to object but not the right to forbid what Allah has made lawful. However, the Hanbali school, as chosen by the Federal Territories Mufti (Irsyad al-Fatwa 299), allows the wife to stipulate in the contract that the husband will not practise polygyny. If that condition is breached, the wife may seek fasakh. See Conditions & taʿliq.

3Myths about the law

The provisions cited are from Act 303 (Federal Territories). Other state enactments are parallel, but their section numbers may differ.

5. “In Malaysia the first wife must consent, or the application is bound to be refused”Fact: Act 303 s.23(3) only requires the applicant to state whether the wife's consent or views have been obtained. The wife is called to the hearing (s.23(4)), and JKSM describes her consent as "a strong additional fact". In Indonesia, the wife's consent is a requirement (UU 1/1974 Article 5(1)(a)). In Singapore, the wife's consent alone is not enough to obtain permission.
6. “Marrying in Thailand is no problem — just register it later”Fact: Court permission is still required for a man resident in the state even if the contract is made abroad (Act 303 s.23(2)). Marrying without it is an offence (s.123), and the marriage must be registered within 6 months (s.31, s.35). Act 1946 in Thailand's four southern provinces has no procedure for polygyny permission. Selangor recorded 1,617 applications to confirm polygyny after the marriage for the period 2019–2022. See Secret polygyny.
7. “If the marriage is valid in Shariah, it need not be registered”Fact: Act 303 s.34 states that registration does not make a marriage valid or invalid. Registration is nonetheless compulsory (s.25), and failing to appear to register a marriage contracted abroad within the prescribed time is an offence (s.31, s.35). Without a certificate, claims for maintenance and inheritance and the registration of children become difficult.
8. “The fine is only RM1,000 — just pay it and it's done”Fact: Besides a fine or imprisonment under s.123, the husband must pay immediately the mahr and gifts owed to an existing wife (s.23(7)). A wife who is not treated justly may apply for fasakh (s.52(1)(h)(vi)). In Indonesia, the new KUHP Article 402 (in force 2026) provides for imprisonment of up to 4 years 6 months, or 6 years if the existing marriage is concealed.
9. “The Syariah Court approves every polygyny application”Fact: More than a third of applications were refused for the period 2019–2023, according to The Straits Times (20 Apr 2024) based on JKSM data. Approval rates also differ by state: in the Federal Territories, 662 of 901 applications (73%) were approved for 2019–2022, and in Kedah only 157 of 372 (42%) — figures for the FT and Kedah only (Jurnal Pembangunan Sosial UUM, 2024).

4Myths about the rights of wives and children

10. “Children of a second wife have no rights, or lesser rights”Fact: A child's lineage is established to the father through a valid marriage (al-walad lil-firash, Sahih al-Bukhari 6749). A child's maintenance and faraid share do not depend on whether the mother is the first or second wife. The problem that arises is one of proof: an unregistered marriage makes the paperwork difficult. See Custody & lineage.
11. “A second wife whose marriage is unregistered does not inherit”Fact: A wife's faraid rights depend on the validity of the marriage, not its registration (Surah an-Nisa' 4:12; Act 303 s.34). But without a certificate she must apply to the Syariah Court to confirm the marriage, and the other heirs may dispute it. Registering the marriage while the husband is still alive is far safer.
12. “Being just means love must be equal”Fact: Surah an-Nisa' 4:129 acknowledges that hearts cannot be made equal. But the rotation of nights, maintenance, housing and outward treatment must be just. A husband who inclines entirely to one wife is sternly warned (Sunan Abu Dawud 2133, sahih). See Fiqh of polygyny.

5Myths about society and the numbers

14. “Polygyny reduces divorce”Fact: We have found no peer-reviewed study showing that polygyny reduces divorce in modern Muslim societies. In Indonesia, polygyny was recorded as the cause in 738 divorce cases in 2023 (BPS data). A meta-analysis found higher psychological distress among wives in polygynous marriages, though it shows only an association, not a cause. See Studies & research.
15. “Polygyny is rising in Malaysia”Fact: Polygynous marriages in the Peninsula and Sabah fell from 3,064 (2019) to 1,609 (2023), about 47%, according to The Straits Times based on JKSM data. In Indonesia, polygyny permission cases fell from 1,134 (2019) to 720 (2025).
16. “The Prophet ﷺ married many wives purely out of desire”Fact: He took no other wife for the whole of Khadijah's life r.a.. His later marriages had contexts of daʿwah, society and law, and he had particular rulings that do not apply to the ummah (Surah al-Ahzab 33:50). See The Prophet's ﷺ household.

6How to check claims yourself

  • Ask for the verse number or hadith number, then check it yourself in a recognised source such as sunnah.com or the mushaf.
  • For the law, ask for the name of the Act or Enactment and the section number. Islamic family law in Malaysia is state law.
  • For figures, ask who published them and in what year. Figures without a source are best ignored.
  • Distinguish between fiqh rulings (valid or not, sinful or not) and the law of the land (registered or not, an offence or not).
