Court permission comes before the akad

Polygyny in Malaysia requires the prior written permission of the Syariah Court. Marrying without it is an offence under state enactments — even if the marriage is valid in Islamic law.

Four conditions — all of them, not just one

The Syariah Court grants permission only if it is satisfied on all four of these matters. If one fails, the application fails.

Process

Seven steps, in the right order

Four of them take place in court. The marriage comes only after permission.

Assess yourself firstFinancial ability, existing dependants, and the real reason — the calculator and the four conditions.
Gather documentsFinancial statements, existing marriage certificate, details of dependants and the existing wife's address.
File the applicationCourtTo your state's Syariah High Court (JKSM Practice Direction No. 14/2006) — not merely the religious affairs office.
Existing wife is summonedCourtShe has the right to attend and be heard; the prospective wife and her wali (guardian) may also be summoned.
The judge assesses four conditionsCourtJust or necessary · ability · justice · no harm recognised by Syariah law (darar syarie). All must be met.
DecisionCourtGranted, or refused. The decision may be appealed under the state Syariah court procedure.
Only then marry and registerAfter permissionWith the permission order: marriage application, akad, and registration of the marriage at the religious office.
The general form is the same in all states; forms and fees differ — see States.
