Secret polygyny and marriage without permission
Secret polygyny is a second marriage hidden from the wife, the court or the registrar. From the standpoint of fiqh the akad may be valid, but in law it is an offence. Its effects fall most heavily on the wife and children. This page explains the law, the official data, how to put the situation right, and the steps for a wife who finds out.
- Understanding the difference between valid in fiqh and valid in law
- Knowing the legal consequences of polygyny without permission in Malaysia
- Identifying the rights of a wife who has just found out about a secret marriage
Key point: A contract that fulfils the pillars may be valid in fiqh, but keeping it secret and avoiding the court is the wrong that harms wives and children most. An affected wife has clear rights — mahr, maintenance, a just rotation, fasakh and the right to complain — and is entitled to take time before making a decision.
- Check your marriage certificate and taʿliq (conditional divorce) pronouncement so you know the rights recorded in them
- Save the Talian Kasih number 15999 and the address of your state Syariah Court's advisory service unit
- Intended wife: ask for proof of the court's permission before agreeing to any contract
At a glance
Valid in fiqh does not mean valid in law
- The contract is valid if its pillars and conditions are met and the limit of four is observed
- The wife's consent is not a condition of validity (Dr. Zulkifli 2024; Mufti of Perlis 2023)
- But deception, harm and neglect of rights remain forbidden (2:231; 4:129)
- Written court permission is required first — s.23(1)
- Applies even if the contract was abroad, for residents — s.23(2)
- Marrying without permission: fine up to RM1,000 and/or imprisonment up to 6 months — s.123
- The mahr and gifts owed to the existing wife must be paid immediately — s.23(7)

1What is meant by secret polygyny?
The term covers several different situations:
- Marriage without the court's permission. The contract takes place in the country or abroad, for example in southern Thailand or through a "syndicate marriage", without the written permission of the Syariah Court.
- An unregistered marriage, whether in Malaysia or in the country where the contract took place.
- A marriage hidden from the existing wife, even though the procedure may be in order. This rarely happens because the court must summon the existing wife (Act 303 s.23(4)–(5)).
- Nikah siri in Indonesia, that is, a religious marriage not recorded at the KUA.
For nikah siri, misyar and urfi in general, see Nikah siri, misyar & urfi. For marriages abroad, see Cross-border marriage.
2Fiqh and law: two different questions
From the standpoint of fiqh, a contract that fulfils the pillars and conditions is valid even if the first wife is not informed. Those pillars are the wali, two witnesses, offer and acceptance, and an intended wife who is not impeded, with the limit of four wives observed. Dr. Zulkifli al-Bakri (2024) and the Mufti of Perlis (2023) stress that the wife's permission is not a condition of validity. But valid does not mean sinless. Deception, harm and neglect of the wife's rights are still forbidden (Surah al-Baqarah 2:231; Surah an-Nisa' 4:129).
From the standpoint of Malaysian law, the situation is as follows (using Act 303 for the Federal Territories as the example; the state enactments are parallel but their section numbers may differ):
- A man who is still married may not marry again without the prior written permission of the Court, and such a marriage may not be registered (s.23(1), s.23(1A)). This rule applies even if the contract takes place outside the Federal Territories, if the man is resident there (s.23(2)).
- If the marriage is valid according to Hukum Syarak, the Court may order it to be registered, subject to s.123 (s.23(1A); s.12(2)).
- Registration does not make a marriage valid or invalid. It is legal evidence (s.34).

4Who bears the harm
5Legal consequences in Malaysia
The penalty for this offence is often seen as light. Only 2 of 193 cases in Selangor in 2023 ended in a penalty. But its effects on mahr, maintenance and a Syariah criminal record are still real.
| Matter | Provision (Act 303) | Consequence |
|---|---|---|
| Marrying without the court's permission | s.123 (Selangor: s.124 Enactment 2003) | A fine of up to RM1,000, or imprisonment of up to 6 months, or both |

6Indonesia: the legal position
- UU 1/1974 Article 3–5: the principle is monogamy. Polygyny requires the permission of the Pengadilan Agama, one of the permitted grounds, and three conditions: the wife's consent, means and a guarantee of justice.
- KHI Article 56: a marriage to an additional wife without the permission of the Pengadilan Agama has no legal force.
- SEMA No. 3 of 2018: applications for isbat nikah (confirmation of marriage) for polygyny contracted secretly cannot be accepted, even on the grounds of the children's interests. Researchers note that judicial practice is still not uniform.
- The new KUHP (UU 1/2023), Article 402, in force from 2 January 2026: marrying while knowing there is an existing marriage that is a lawful impediment is punishable by imprisonment of up to 4 years 6 months or a category IV fine. If the impediment is concealed from the other party, the penalty is imprisonment of up to 6 years. MUI disputes its application to men's polygyny and nikah siri (Jan 2026).
- Civil servants (PNS) are also subject to special regulations (PP 10/1983 jo. PP 45/1990).
7How to put things right (for husbands)
- Stop keeping it secret. Tell the existing wife in the least hurtful way. Ideally, do this with the help of a counsellor.
- Gather the contract documents: the foreign marriage certificate or letter, details of the wali and witnesses, and authentication from the Islamic Religious Council and the Malaysian consulate if the marriage took place in Thailand.
- File an application for validation and registration at the Syariah Court of your state (s.23(1A), s.12(2)). The Court will decide whether the contract is valid according to Hukum Syarak.
- Face prosecution under s.123 or the equivalent section in your state. Admitting it and cooperating is usually better than continuing to hide.
- Fulfil s.23(7) by paying the existing wife's mahr and gifts.
- Arrange maintenance and the rotation of nights in writing for each family. See Fiqh of polygyny.
8If you are a wife who has just found out
- Put your own safety and health first. If there are threats or violence, contact the police or Talian Kasih 15999.
- Don't act in anger. A talaq requested in shock is often regretted. You are entitled to ask for time.
- Keep evidence such as messages, photos of the marriage certificate, bank statements and information about the new wife, without breaking the law.
- Know your rights:
- Your mahr (dower) and gifts must be paid immediately (s.23(7)).
- You are entitled to maintenance and a just rotation of nights.
- You may report the offence to the Enforcement Division of the state Islamic Religious Department.
- You may apply for judicial dissolution (fasakh) if you are not treated justly (s.52(1)(h)(vi)).
- You may claim a taʿliq divorce if a taʿliq condition is breached.
- You may claim jointly acquired matrimonial property (harta sepencarian) on divorce.
- Get free or low-cost advice from the Legal Aid Department or the advisory unit of the state Syariah Court, or a Syarie lawyer.
- Think about the children: explain to them according to their age and do not make them messengers between their parents.
- Choosing to stay is also a valid choice. If you stay, ask for the marriage to be registered and for maintenance and the rotation to be set out in writing.
9For the intended second wife
If a married man asks you to marry him "in Thailand first, register later", or wants to keep the marriage secret from his wife, that is a warning sign. A valid, registered marriage is the main protection for you and your child. Ask him to apply for the court's permission first. A man who is able to be just is also able to be honest.
