Q&A › Polygyny: the law

🏛️ Polygyny: the law · #105

Since filing the polygyny application, my husband rarely comes home and gives no maintenance. What can I do?

Your and your children's maintenance (nafkah) remains obligatory throughout the process, and you can claim it at the Syariah Court. Note the date maintenance was last received, current expenses and evidence of neglect. Discuss it with your husband in writing first if possible, so there is a record. If nothing changes, file a maintenance claim or get help from the JAIN family counselling unit. The Prophet ﷺ said: “It is enough for a person to be sinful if he withholds food from those under his care” (Sahih Muslim, Book of Zakat). Also tell the judge at the polygyny hearing, because this behaviour bears on the assessment of his fairness. See enforcing maintenance.
