In Kuwait, what happens if a marriage is not officially documented?
Kuwaiti courts do not hear claims about a marriage that has not been officially documented (Article 92), so a wife may lose the route to claim maintenance, custody and her other rights.
The provision shows how important registration is, in line with Allah's command that important matters be written and witnessed (al-Baqarah 2:282). Malaysians who marry in Kuwait, or anywhere in the Gulf, should make sure the contract goes through a recognised authority and the documents are certified, then register the marriage in Malaysia within the set period. Do not rely on a "religious only" contract with no record; if a dispute or death occurs, the rights of the wife and children are hard to prove in either country. See The Gulf & Iran and Unofficial marriages.
