🚪 Divorce, ʿiddah & rujuk · #110

I was divorced while pregnant. Who bears my maintenance and childbirth costs?

Your iddah continues until you give birth, and throughout that period your ex-husband must provide your maintenance (nafkah), even if the talaq is ba'in (irrevocable). This includes food, housing and the basic needs of pregnancy, according to his means. Once the baby is born, the child's maintenance becomes his responsibility, and Islam recognises the right of a divorced mother to be paid for breastfeeding the child. List expenses such as antenatal check-ups, delivery costs and the baby's needs, and keep the receipts. Discuss it in writing; if no agreement is reached, file a maintenance claim at the Syariah Court. Look after your own health and the pregnancy, and do not hesitate to ask your family for help. See maintenance after divorce.
