A Malaysian wants to marry in Brunei. What should be taken into account?
Follow Brunei's process for the contract, obtain the Malaysian permissions required (including polygamy permission if already married), and register the marriage in Malaysia afterwards; one permission does not replace another.
A Malaysian husband who is already married needs the Syariah Court's permission in Malaysia, and if the contract is in Brunei, he must also meet Brunei's process (Islamic Family Law Act, Chapter 217, s.23). The marriage must be registered with the state religious office or the Malaysian High Commission in Bandar Seri Begawan within the period set by the state enactment. Sabahans and Sarawakians marrying in Brunei are subject to their own state's Islamic family enactment or ordinance. Allah tells us to record important matters (al-Baqarah 2:282); keep the original documents and certified copies. See Brunei.
