In Brunei, may a husband pronounce talak outside court?
Muslim divorces in Brunei go through the Syariah Court, and pronouncing talak outside court without permission is an offence under Brunei's Islamic family law.
Chapter 217 provides for a divorce application with reconciliation attempted first (s.42), syiqaq with arbiters (s.43), dissolution for syarie harm (s.44), taʿliq divorce (s.45), fasakh (s.46), khulʿ (s.48) and liʿan (s.49), while talak outside court without permission is an offence (s.124). Mutʿah, ʿiddah maintenance, custody and jointly acquired property are claimed at the Syariah Court. This approach is in line with Allah's command to reconcile couples through arbiters before they part (an-Nisa' 4:35). Malaysians married or living in Brunei must also make sure the divorce is registered in Malaysia. See Brunei.
