🚪 Divorce, ʿiddah & rujuk · #127
We keep quarrelling and cannot agree about divorce. What is syiqaq, and when is a hakam appointed?
Syiqaq is persistent discord between husband and wife, and in this situation the court may appoint a hakam (arbitrator) from each side to reconcile you or decide a way out. Allah says: “then appoint an arbitrator from the men's family and an arbitrator from the women's family” (Surah an-Nisa' 4:35). A hakam is usually chosen from family members or people who understand the situation of you both. They listen to both sides and try to reconcile you first. If you are heading for this process, think about who is fair and calm to propose, not who will side with you most loudly. The procedure and powers of the hakam are set by the Syariah Court, so ask at the court counter about the steps. Read also syariah Court procedure.
