Q&A › Divorce, ʿiddah & rujuk

🚪 Divorce, ʿiddah & rujuk · #125

Can we agree between ourselves on dividing property after divorce, without a trial?

Yes, and this is often quicker, cheaper and less hurtful, as long as the agreement is fair and recorded. Start by listing all the property and debts acquired during the marriage, including the house, vehicles, savings and businesses. Discuss the value of each one honestly. Allah says: “reconciliation is better” (Surah an-Nisa' 4:128). If the discussion stalls, a sulh session at the Syariah Court can help the two of you reach agreement. The agreement can then be recorded as a court order so that it is binding. Do not sign anything you do not yet understand; ask for time to think or to get advice. Read the explanation at matrimonial property (harta sepencarian).
