🚪 Divorce, ʿiddah & rujuk · #67
My husband divorced me without telling me; I found out months later. When does my ʿiddah begin?
According to the Shafi'i school, the ʿiddah begins from the date talak was pronounced, not from when the wife learns of it; if the ʿiddah period has already passed, it has ended.
Allah commands divorced women to count the ʿiddah (at-Talaq 65:1), and the count is tied to when the talak happened. But in Malaysian practice, the date of the talak must be proven and confirmed by the Syariah Court, because a husband may claim an inaccurate date. Hiding a divorce denies the wife rights such as ʿiddah maintenance and the chance of reconciliation, and failing to report a divorce is an offence (Act 303 s.125). The wife may apply for confirmation and claim ʿiddah maintenance, mut'ah and other rights. If the husband continued living with her as a wife after the talak without valid rujuʿ, consult the religious office at once. See ʿIddah & reconciliation.
