A wife runs a business with capital from her husband. Who owns the profit?
It depends on the agreement between them: if the capital was a gift, the business and its profit belong to the wife; if a loan, she must return the capital; if a partnership, profit is shared as agreed.
Allah permits trade by mutual consent (an-Nisa' 4:29) and commands that financial dealings over a term be written down (al-Baqarah 2:282). Many couples never clarify the status of the capital, so disputes arise when the business succeeds or on divorce. Write it down briefly: the amount of capital, whether it is a gift, a loan or a partnership (musharakah or mudarabah), and the profit ratio. A wife who runs a business is still entitled to maintenance from her husband; her income does not cancel his obligation. Make sure the business is registered and keep its accounts separate from household money. See Family finances.
