A husband asks his wife to be his guarantor or to take a loan in her name for him. Should she agree?
She has the right to refuse, and if she agrees she must understand that legally she is the one who will be pursued if payments are not made.
The Quran commands that every debt over a term be written down clearly (al-Baqarah 2:282), and forbids consuming others' wealth unjustly (an-Nisa' 4:29). Many wives, especially after divorce or when the husband marries again, find themselves blacklisted over a loan their husband used. Before agreeing: ask what the loan is for, whether he can afford the payments, what happens on divorce or death, and ask for a written agreement that he bears the payments. Make sure she has access to the loan account statements. Do not agree under pressure, or to fund the husband's new marriage. If already caught up, get advice from AKPK. See Family finances.
