The deceased's estate has gone undivided for years. What are the consequences, and is it a sin?
Delaying division without reason can wrong the heirs, especially orphans and widows, and often causes disputes and neglected property; settle it as soon as possible after debts and the bequest.
Allah gives a stern warning to those who consume orphans' property unjustly (an-Nisa' 4:10), and affirms that the heirs' shares are His decree (4:11). Common effects of delay: heirs die before division so estates pile up in layers, documents are lost, land is pawned or encroached on, and family ties weaken. Steps: gather the death and property documents; determine the right channel — the land office, Amanah Raya or the High Court depending on the type and value of property; obtain a faraid certificate from the Syariah Court; and appoint a trustworthy administrator. If heirs disagree, use mediation or the court. See Managing an estate.
