Q&A › Divorce, ʿiddah & rujuk

🚪 Divorce, ʿiddah & rujuk · #53

My husband has breached the taʿliq, for example not providing maintenance or leaving me for months. How do I apply for a taʿliq divorce?

The wife files an application at the Syariah Court to confirm a taʿliq divorce, proving that the conditions of the taʿliq have been breached; if the court is satisfied, the divorce is confirmed and registered.
Act 303 s.50 allows a wife to apply for confirmation of divorce when a condition in the taʿliq certificate has occurred. The taʿliq read after the contract in Malaysia usually covers leaving the wife for a set period or failing to provide maintenance, with the wife complaining to the court; the exact wording is on your taʿliq certificate. Useful evidence: the marriage and taʿliq certificates, records of maintenance given or not given, messages, witnesses, and any reports. The wife may also claim arrears of maintenance, mutʿah and jointly acquired property. If the taʿliq does not fit, fasakh under s.52 is another option. See what taʿliq means and Syariah Court procedure.
