My husband pronounced talak, or we divorced, abroad. How is it confirmed in Malaysia?
A divorce abroad needs to be registered or confirmed in Malaysia so your status is recognised, especially for remarriage, custody and property.
Act 303 s.55A provides for the registration of divorces outside the court, and failure to report a divorce can be an offence (s.124, s.125). If the divorce was decided by a Syariah court or religious authority of another country, bring the certified original documents and an official translation to the Syariah Court or religious office of the state where you live. If talak was pronounced orally or by message while the husband was abroad, the wife may file an application to confirm the pronouncement in Malaysia. The validity of the pronouncement and the date the talak took effect matter for calculating the ʿiddah. Get advice from a Syariah lawyer. See Across borders.
