My former husband is not paying the mut'ah or maintenance ordered by the court. What action can be taken?
Go back to the Syariah Court for enforcement; the court can order salary deductions, seizure of property and, for wilful default, imprisonment.
Allah commands that divorced women be given mutʿah in a fair way as a duty on the God-conscious (al-Baqarah 2:241), and the Prophet ﷺ called delay by one who can pay an injustice (Sahih al-Bukhari 2400). Act 303 s.132 allows the court to punish wilful non-compliance, including imprisonment for each month's payment outstanding. Arrears of maintenance can be claimed as a debt (s.69). Keep a record of every payment made or missed. Some states also have dedicated enforcement and family support divisions that help collect payments. See Enforcing maintenance.
