How long does a divorce at the Syariah Court usually take, and what does it cost?
It varies greatly with the type of case: a divorce by mutual agreement can be completed within a few months, while contested cases such as fasakh or property claims can take much longer.
Allah tells us to part in a good way (al-Baqarah 2:229), and the court process aims to protect both parties' rights. Factors affecting the length: whether the husband agrees, the need for a Conciliatory Committee or arbiters, sulh, the number of related claims (maintenance, custody, jointly acquired property) and whether the parties attend. The main costs are modest court fees and lawyer's fees if one is appointed; a wife of limited means can apply to the Legal Aid Department. Settling matters by agreement through sulh is usually quicker and cheaper. See Syariah Court procedure.
