Q&A › Preparation & choosing a spouse

🧭 Preparation & choosing a spouse · #61

My future husband says he is divorced, but the court case is not finished. Should we go ahead?

Wait until the divorce is truly valid and registered, and ask to see the documents; if he is in fact still married, a new marriage requires permission for polygamy.
Allah tells us to verify news before acting (al-Hujurat 49:6). In Malaysia, a divorce must be confirmed and registered, and a man who is still married may not marry again without the Syariah Court's written permission (Act 303 s.23). For a divorced woman, a new contract is only valid after her ʿiddah ends. Many women end up in unregistered marriages because they believed it was "almost finished". Ask for a copy of the divorce certificate or court order, check with the religious office, and do not rush even under pressure. If he refuses to show documents, that is a warning sign. See The prospective second wife.
