🌍 Children, inheritance & global · #208

My husband is applying for polygamy. Can I ask the court to set our children’s maintenance in the same case?

Yes; Act 303 gives the court power to order child maintenance when permitting polygamy. Section 73(1)(e) lets the court order a man to pay maintenance for the benefit of his child when permitting him to practise polygamy under s.23(1). Section 23(9)(a) lets the court order maintenance for the existing wife. Prepare a list of the children's expenses, such as school, food, medical care and transport, so the court can assess a reasonable amount. Section numbers in state enactments may differ; check your state page. Allah says: “Let the one who has means spend according to his means” (Surah at-Talaq 65:7). See The existing wife.
