📜 Akad nikah · #25

If divorced before consummation, does the wife receive the full mahr?

The wife is entitled to half the mahr that was agreed if she is divorced before consummation.
Allah says that if you divorce wives before touching them when the mahr has been agreed, pay half of what was agreed, unless the wife or the wali forgoes it. If no mahr was agreed, the wife is entitled to mutʿah (consolatory gift). If either spouse dies before they have been together, the full mahr becomes the wife's right. See Mahr.
Difference of madhhab. The Hanafis and Hanbalis require the full mahr if a valid seclusion (khalwah sahihah, being alone together without impediment) took place even without intercourse; the Shafi'is (qaul jadid) require only half.
