⚖️ Polygyny: rulings & justice · #57
An elderly man wants to take another wife. What should be considered?
Age alone is no bar, but health, finances, a reasonable span of life in which to carry out the responsibilities, and the effect on the existing wife and children must be weighed honestly.
The main conditions of polygamy are justice and ability (an-Nisa' 4:3), and the Syariah Court weighs financial ability, fairness and syarie harm (Act 303 s.23). For an older man, key questions: who will care for him if he becomes frail; how will a young wife and any children be maintained if he dies; is the first wife's jointly acquired property already clear; and are a will and gifts planned to prevent disputes? A much younger prospective wife must also understand this reality. An intention to give companionship and care can be good, but it must come with planning. See the question on financial ability.
