What forms of divorce are recognised for Muslims in the Philippines?
PD 1083 Art. 45 defines divorce as a dissolution granted only after all efforts at reconciliation have failed, and recognises forms such as talak, ilaʾ, zihar, liʿan, khulʿ, tafwid and fasakh.
Muslims are the only group in the Philippines who can lawfully divorce within the country. Talak under Art. 46 is a single pronouncement during a period of purity without intercourse, and several pronouncements within one period of purity count as one; reconciliation may take place within the ʿiddah without a new contract. Ilaʾ (Art. 47) lets a wife obtain a divorce order if the husband swears not to be intimate with her for at least four months. Divorces must be registered with the Shariʿa registrar. These principles match the Quran's call for reconciliation through arbiters (an-Nisa' 4:35) and gradual talak (al-Baqarah 2:229). Malaysians who divorce in the Philippines must register it in Malaysia. See The Philippines.
