🕌 Worship in the home · #47
A husband and wife were intimate but there was no emission. Is the obligatory bath still required?
Yes. According to the Shafi'i school and the majority, intercourse requires both partners to bathe as soon as penetration occurs, even without emission.
The Prophet ﷺ said that when a man sits between his wife's four limbs and exerts himself with her, the bath becomes obligatory (Sahih al-Bukhari 291); Muslim's narration adds "even if there is no emission" (Sahih Muslim, Kitab al-Haid). In early Islam there was a concession that the bath was only required on emission, but that ruling was later abrogated. For the wife, the bath is required even if she did not reach climax. Intimacy without penetration and without emission does not require the bath, but if there is madhi, wudu is broken and the spot is washed. See Wudu & the obligatory bath.
