Q&A › Preparation & choosing a spouse

🧭 Preparation & choosing a spouse · #51

I want to marry a foreign national. What needs to be prepared legally?

Plan early because two systems are involved: permission to marry from the state religious office, documents on the foreign partner's marital status and Muslim status, and immigration matters after the marriage.
Allah made people into nations so they might know one another (al-Hujurat 49:13), and a marriage across countries is valid if its pillars and conditions are met. In Malaysia, an application to marry usually requires a certified declaration of single status or divorce documents from the home country, confirmation of religion (for a convert, a certificate of conversion), the guardian's consent, and sometimes a letter from the embassy. The guardian for a foreign woman must be established; if there is no guardian by kinship, a judge-appointed guardian may be involved. After marriage, the foreign spouse needs a suitable pass to live here. Avoid syndicate marriages at the border; register the marriage properly. See Marrying abroad and the question on spouse passes.
