🏛️ Polygyny: the law · #51
Must the prospective second wife and her guardian attend the hearing of a polygamy application?
Yes. Act 303 s.23(4) requires the court to summon the applicant, the existing wife or wives, the woman to be married and her guardian, and anyone who can give relevant information.
Their attendance lets the court see the full picture: the prospective wife understands that the man is already married and knows his financial position, her guardian consents with real knowledge, and the existing wife can voice her views. This fits Allah's command to verify matters before acting (al-Hujurat 49:6). Hearings are usually held in chambers, not open to the public. Bring identity cards and the documents requested. For the prospective wife, this is a last chance to ask important questions before the contract. State enactments have similar provisions; check your state. See the question on hearings in chambers.
