🚪 Divorce, ʿiddah & rujuk · #64
What happens at a session to confirm a pronouncement of talak at the Syariah Court?
The court hears both husband and wife on the time, place and manner in which the words were said, then decides whether the talak is valid and how many, and orders its registration.
Allah commands that divorce be witnessed by two just people (at-Talaq 65:2), and Act 303 s.55A provides for registering a divorce outside court once confirmed. Usual questions: the exact words used (explicit or implicit), the husband's state at the time (angry, of sound mind, coerced), the number of earlier talaks, and whether the wife was menstruating or pure. Bring the marriage certificate, identity cards and evidence such as messages if the talak was in writing. The court may also impose a penalty for divorcing outside court without permission (s.124). Answer honestly; the date of the talak determines the ʿiddah. See the question on talak outside court.
