The deceased's house is being rented out until the estate is divided. Who does the rent belong to?
The rent belongs to all the heirs according to their respective faraid shares, not to the person who collects it. Income from estate property follows the ownership of that property. The heir who manages the letting can deduct actual costs, such as assessment tax, insurance and repairs, with proof. He may also receive a management fee if everyone agrees. Open a dedicated account for the rent, and share a brief statement with all the heirs every few months. This prevents suspicion and makes the eventual division easier. If the house will be let for a long time, set a written agreement among the heirs on who manages it. See managing an estate.
