My siblings want to sell our late father's house, while our mother still lives there. What should we do?
The house is jointly owned by all the heirs, including Mother, so a sale needs consent or a lawful decision, not pressure from the majority. Siblings who need money do have a right, but Mother also has a right and feelings. That house holds her whole life. Sit down together before making a decision, and list the options available. A child who can afford it may buy out the other siblings' shares, Mother may stay on while shares are paid in instalments, or the house may be rented out and the income divided. If a sale cannot be avoided, make sure Mother has suitable accommodation first. Allah says: “And, out of kindness, lower to them the wing of humility” (Surah al-Isra' 17:24). A sulh officer can help if negotiations between siblings reach a deadlock. See faraid in the family.
