Is the land my husband inherited from his late father part of jointly acquired property?
In principle, no; property inherited by or gifted (hibah) to one spouse is that spouse's personal property. But the position can change if the property was developed or its value increased through joint effort during the marriage. For example, inherited land that the two of you worked until it became a productive orchard, or on which a house was built with joint money. In such cases, your contribution to the increase in value may be claimable. Gather evidence such as building receipts, payments of workers' wages and records of sales proceeds. The Syariah Court will assess each case on its facts, so get advice from a syarie lawyer before filing a claim. See also matrimonial property (harta sepencarian).
