Can we settle harta sepencarian amicably without a long trial?
Yes, and most Syariah courts will refer the case to a sulh session first. In sulh, both parties discuss before a sulh officer to reach agreement on which assets will be divided, sold or transferred. An agreement reached can be recorded as a court order, so it binds like a decision after trial. This is often quicker, cheaper and less painful, especially where there are children who still need to be raised together. The Quran says that “reconciliation is better” (Surah an-Nisa' 4:128). Prepare a list of assets and evidence before the sulh session so the discussion rests on facts. See Syariah Court procedure.
