🏛️ Polygyny: the law · #133
Can my husband just send a lawyer to the polygyny hearing without attending himself?
Usually not; the court calls the applicant himself to attend and be heard. The judge must assess the applicant's reasons, means and readiness to be fair, and that is hard to assess without meeting him. The existing wife, the prospective wife and her wali are also called, and the hearing is held in chambers. A lawyer can represent and assist the applicant, but not replace his attendance. If the applicant fails to attend without a reasonable excuse, the case can be adjourned or dismissed. As the wife, you can bring your own Syarie lawyer and prepare your evidence in advance.
