🌍 Children, inheritance & global · #54
The deceased had no children and both parents had died. Who inherits besides the wife?
This situation is called kalalah: after the wife's share (one quarter, as there are no children), relatives such as siblings inherit as the Quran sets out.
Allah explains kalalah in an-Nisa' 4:12 (for maternal siblings) and 4:176 (for full or paternal siblings): one sister receives half, two or more receive two thirds, and if there are brothers and sisters, a brother receives twice a sister's share. Maternal siblings receive a sixth for one, or a third shared equally if more. If there are no siblings, the remainder goes to the next agnatic heirs such as nephews through brothers or paternal uncles. Combinations of heirs can be complex, so ask the Syariah Court or the estate office for an official calculation. See Faraid and the question on a wife with no children.
