📜 Akad nikah · #84

I am a divorcee. Do I still need a wali to remarry?

Yes; in the Shafi'i school practised in Malaysia, a previously married woman also needs a wali, but her consent must be stated clearly. Unlike a woman who has never married, a previously married woman's permission is not given by silence. She must state her agreement, and the wali cannot marry her off without her willingness. If your father has passed away, your wali is the next paternal guardian in order. If the wali refuses without a reasonable cause, the Syariah Court can allow a wali hakim. Make sure your waiting period (iddah) has ended before applying, and prepare your divorce documents or your husband's death certificate. The marriage officer at the religious office can explain the steps. See remarriage.
