My husband once gave me a car as a gift. Is it a hibah or harta sepencarian?
Hibah and harta sepencarian are two different things, and the facts of the gift decide which it is. A hibah is a voluntary gift made during life that takes effect when it is handed over and accepted; it is not a claim in court. Harta sepencarian is a right to claim a share of property jointly acquired during the marriage, assessed under Act 303 s.122 on divorce. If the car really was given as a hibah, keep evidence such as the change of name on the registration, a hibah letter or witnesses. If there is a dispute over whether something was a hibah, the court will weigh the evidence. For your situation, please get advice from a Syariah lawyer. See Harta sepencarian.
