🏛️ Polygyny: the law · #131
The prospective second wife is already pregnant. Can we marry straight away without waiting for the court's permission?
No; pregnancy does not remove the obligation to apply for permission for polygyny. Marrying without permission, including abroad, is an offence and will add to the problem, not solve it. The right steps: repent, be open with the existing wife, and file the application immediately. Ask the Syariah Court whether the case can be heard earlier. Understand the effect on the child too: a child born less than six lunar months after the akad cannot be attributed to the husband in lineage (nasab). Get advice from the religious office on the child's status and the mother's rights. See Hadhanah & lineage.
