Islamic Family Law Enactment 2006
Islamic family law for Perlis, as held by this site. Every section has its own address, so references on this site can open the exact section.
Section 23 in Perlis differs from the other States. In the text held (the portal’s “updated” text, which incorporates amendment En. A19/2008), s.23 has nine subsections, not ten. The four conditions are at s.23(5)(a)–(d), but s.23(5) requires the Court to summon the applicant only, and there is no subsection requiring the application to be served on the existing wife. So the appeal is s.23(6), mas kahwin s.23(7), and the maintenance or asset-division order is s.23(9), not s.23(10).
An archive copy, not the current text. The e-Syariah portal did not answer on 13 October 2026 (UTC), so every section below was taken from the Internet Archive (Wayback Machine) copy of that portal, captures 2016–2023. Amendments made after the capture date are not included.
Key Parts only. What is held is the long title, sections 1 to 41 (preliminary, marriage, polygamy, registration and related offences) and section 120 to the end (harta sepencarian, appeals, penalties and general). Sections 42 to 119 (dissolution of marriage, maintenance, guardianship and legitimacy) were not fetched. The list of sections held is below.

Definition of “Court”
What this text shows
- The offence of polygamy without permission is s.124, not s.123, because s.123 in this enactment is the appeals section. Its maximum penalty is the same as Act 303 s.123.
- Section 23 says only “the Court”. Section 2 defines it as the Syariah Subordinate Court or the Syariah High Court, as the case may be. The enactment itself does not fix the level of court for a polygamy application.
- Court practice in Perlis may still summon and hear the existing wife, but that requirement does not come from the text of s.23 as held.
- Polygamy applications are heard in the Syariah High Court because of JKSM Practice Direction No. 14 of 2006 (in effect from 1 June 2006), not because of this enactment; the text of that practice direction was read on 14 October 2026.
Verified against a primary source
- Commencement date: 1 January 2010. Perlis Government Gazette, Vol. 53 No. 4, 18 February 2010, notification No. 9 (dated 25 January 2010): “Raja Pemerintah menetapkan 1 Januari 2010 sebagai tarikh permulaan kuat kuasa Enakmen.” Notification No. 11 in the same gazette sets the same date for the Islamic Family Law Enactment (Amendment) 2008 [Enactment A19]. The date “1 January 2006” on the portal's English header is wrong. Source: gazette scan in the Sinar Project archive; checked 14 Oct 2026.
To be checked for this State
- The original section 23 (before En. A19/2008) is not compared here; to see whether it was the 2008 amendment that removed the summons to existing wives, consult the official text. The 2006 Enactment and amendment A19 came into force on the same date, 1 January 2010.
- The maximum fine in s.39 (unauthorised solemnization) differs between the two portal texts: the Malay text says “satu ribu ringgit”, the English text “two thousand ringgit”. Only the gazette can settle it.
- Harta sepencarian (s.122): the Malay text reads “pembahagian yang sama banyak”, while the English text reads “incline towards equality”. The two portal texts do not say the same thing.
- Other amendments: the Majlis Agama Islam dan Adat Istiadat Melayu Perlis site (maips.gov.my) holds gazette copies of Enactment A13 (Amendment) 2007 (s.2, definition of “bermastautin”), A52 (Amendment) 2017 (s.2, definition of “Hukum Syarak”), A68 (Validation) 2023 (validating fees collected from 1 January 2010 to 14 September 2023) and A69 (Amendment) 2023 (s.135(3), in force 1 January 2024). None of them amends s.8, s.23, ss.38 to 40, s.122 or s.124. To confirm whether that list is complete, consult the official text. Checked 14 Oct 2026.
