My wife has died and her family is claiming a share of her property. Should I agree?
If your late wife's parents are still alive, they are indeed lawful heirs, and their right must be fulfilled. Many husbands assume a wife's property automatically becomes the husband's. In fact, the husband receives one quarter if there are children, or half if there are none. The rest belongs to the other heirs, including the deceased's parents and children. First separate the property that truly belonged to her, such as her savings, her jewellery and assets in her name, from property that is your own. List everything openly to her family. Transparency like this preserves the family ties that still connect your children with their grandparents. Allah says: “And reverence Allah, through Whom ye demand your mutual (rights), and (reverence) the wombs (that bore you)” (Surah an-Nisa' 4:1). See the husband's share.
