🏛️ Polygyny: the law · #63

What offence is committed by unauthorised officiants or syndicates who marry polygamous couples unlawfully?

Act 303 s.39 makes it an offence to solemnise or purport to solemnise a marriage without authority, and s.40 lists offences relating to solemnisation; state enactments have matching provisions.
Allah forbids cooperating in sin and transgression (al-Maʾidah 5:2). Marriage syndicates usually promise a "quick marriage without court" at the border or at home, with doubtful guardians and witnesses. As a result, the marriage may be invalid, cannot be registered, and the woman and children lose legal protection. If you were married this way, ask the religious office about confirming or renewing the marriage. Report syndicates to the state religious office or the police. See the dangers of border marriage syndicates.
