🌍 Children, inheritance & global · #218

I have been laid off and now have no salary. What should I do about the monthly payments for my children ordered by the court?

Keep paying what you can, and promptly ask the Syariah court to vary the order. Allah says: “Let the one who has means spend according to his means; and whoever's provision is restricted, let him spend from what Allah has given him” (Surah at-Talaq 65:7). The law allows a child maintenance order to be varied when circumstances change materially, but only the court can change it. Stopping payment without applying only adds to the arrears, and those arrears remain a debt. Bring evidence such as your termination letter, bank statements and your efforts to find new work. Tell your ex-wife honestly so she can plan the children's expenses. See enforcing maintenance.
