Living in a Western country: do I need to make an Islamic will?
Very necessary. In most Western countries, if someone dies without a will (intestate), their estate is divided under civil law that differs from faraid; for example a spouse may receive most of the estate, while parents or siblings receive nothing. An Islamic will prepared with a local lawyer can direct that the estate be divided according to faraid, with 1/3 for a free bequest. However, local law may allow a spouse or dependants to claim additional provision. If you have more than one wife (for example a marriage contracted abroad), get specific advice, because recognition of a second wife varies. See Muslim minorities in the West.
